To ensure top quality of services, in particular to optimise the available content, adapt content to users’ preferences, and for advertising and statistical purposes, the website at https://triasint.com (“Website”) uses cookies, which enable remembering selected information about the Website’s users. The Website obtains information on users and their activity in the following way:

  1. from information provided voluntarily by the user in forms;

I. Information provided in forms

1. The Website collects information provided voluntarily by the user in contact forms.

2. The entity acting as the controller of the user’s personal data, i.e. the entity that determines the purposes and manner of personal data processing, is TRIAS International LLC, a Delaware Limited Liability Company [hereinafter referred to as the “Company”] with its registered office at 80 Pine Street, Suite 3302, New York, NY 10005, United States of America.

3. User’s personal data were collected during the ongoing cooperation or communication, i.e. directly from you upon the execution of the contract for the provision of services, during our social or statutory activities, or during the preparation of subscription lists.

4. The Website processes personal data to obtain information on the scope of services provided, performance of agreements, or for reasons directly resulting from the applicable laws. Personal data are also processed on grounds of the legitimate interests of the Website, which are:

  • conducting marketing activities, including direct marketing of own goods and services or goods and services of third parties;
  • contacting you for purposes related to permitted marketing activities, through available communication channels, in particular by e-mail and phone, subject to your consent;
  • debt collection; conducting court, arbitration and mediation proceedings;
  • conducting statistical analyses;
  • storing data for archiving purposes and ensuring accountability (demonstrating compliance with obligations arising from the law).

The information provided in forms may be made available to entities supporting or intermediating in the provision of services, performance of executed agreements, as well as to public authorities, in connection with obligations arising from the generally applicable law or court decisions. Your personal data are also made available to members of the Trias Group. The Trias Group means all entities controlled directly or indirectly by TRIAS S.A., a company established under Polish law, with its registered office at ul. Kabaretowa 21, 01-942 Warsaw, Poland, entered in the Business Register of the National Court Register maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under No. 0000306141, holding Industry Identification Number (REGON): 870461658, 8791823379, with the share capital of PLN 2,877,192 [fully paid up], and TRIAS S.A. Pursuant to Art. 4.4 of the Act on Competition and Consumer Protection of
16 February 2007 [Dz. U. of 2019, item 369, as amended], under which acquisition of control means any form of direct or indirect acquisition of powers which, severally or jointly, taking into consideration all legal or factual circumstances, enable the acquiring entity to exert a decisive influence over another entity or entities, in particular, such powers consist of:

  • holding directly or indirectly the majority of votes at the shareholders meeting, including as a pledgee or usufructuary, or in the management board, of another entity (a subsidiary), including under arrangements with other persons,
  • the power to appoint or remove the majority of members of the management board or supervisory board of another entity (a subsidiary), including under arrangements with other persons,
  • members of the entity’s management board or supervisory board accounting for more than half of the members of the management board of another entity (a subsidiary).

6. If personal data are transferred to members of the Trias Group, they may be transferred to the European Union, thus they will be subject to the protection of rights under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), right of access, rectification and erasure of personal data, right of restriction of their processing, right to data portability, right not to be subject to automated decision-making, as well as the right to object to the processing of personal data. In connection with the processing of your personal data by the Website, you have the right to lodge a complaint with the supervisory body, i.e. the Inspector General for Personal Data Protection (address: Inspector General for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

7. Personal data are stored for the term of the executed agreement and after its termination for the purposes of:

  • pursuing claims in connection with the performance of the agreement,
  • performing obligations provided for in the law, in particular tax and accounting laws,
  • preventing abuse and fraud,
  • statistical and archiving purposes.

Personal data are stored for marketing purposes for the term of the agreement or until you object to such processing, whichever occurs first.

8. Personal data may be transferred outside the European Economic Area to Google LLC under relevant legal safeguards, in particular Commission Implementing Decision (EU) 2016/1250 pursuant to Directive 95/46/EC of the European Parliament and of the Council on the adequacy of the protection provided by the EU-U.S. Privacy Shield (notified under document C(2016) 4176).

9. The Website does not process your personal data by automated means (including profiling).

The processed personal data are stored and secured in accordance with the principles set out in the applicable laws, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

11. The Website implements comprehensive technical measures to prevent access and modification of information provided by the user by unauthorised persons.

Copyrights

All content, copyrights and other intellectual property rights in the content available on the Website, including, without limitation, design, text, graphics, interfaces, and the selection and arrangements thereof (collectively referred to as “Content”), are owned by the Company, with all rights reserved, or in some cases may be licensed to the Company by third parties. Content is protected by intellectual property rights of the Company or such third-party owners.

Any use of information, photos, graphics or any other content on the Website, including, without limitation, reproduction, modification, distribution, replication, any form of data extraction, without prior written consent of the Company is strictly prohibited.
